Refused To Refund For Spoilt Food

Ordered 4 cupcakes from a place called Dessert Heaven in hyderabad. One of the cupcake was stale and spoilt. So raised a complaint with Swiggy. Customer service closed my request saying it's packaged/packed food.
Meaning that the restaurant did not prepare the food at all, they just packed and sent. But it is not a packaged food at all, they baked it and sent. I don't know how swiggy can define legal terms like packaged food on their own.
