KSR Properties Pvt Ltd: Builder Is Not Registering Flat Even After 100% Payment As Per Agreement

I have purchased Flat No. CB-00-06, KSR Cordelia Apartment in March 2017. I have taken Loan for it and paid my all obligations by May 2020. Builder has allowed to stay in the Flat from Sept 2020 and after various follow up builder has provided Possession letter on 30th Aug 2021.

Recently PNB bank has visited this flat and inform me that this Flat has Mortgage of 40 Lakhs and he will issue notice for Auction. I have issued Legal notice to Builder to provide me ownership of the flat as i have fulfilled all the obligations as per agreement but they are buying time and not registering the Flat on my name.

Builder has obtained Occupancy Certificate from BBMP Authorities in 2018. That one of the conditions in the said Sale Agreement was that the registration of the flat would be done only after construction and completion of project. It has been completed in 2018.
I have sent legal Notice also to builder on 9th Sep 2021.

They have not replied back on this concern. I have gone to SBI Bank also who has sanctioned Loan against this property without completing Mortgage validation or verify sales agreement. However i have paid all Loan amount to SBI. From Investigation.

We come to know that PNB Bank has given mortgage amount to builder on one name who is not a genuine buyer. I am only the genuine buyer for this flat and i want builder should complete registration of this flat on my name.

Gist: Accused is a builder who sold Flat no. CB-00-06 in KSR Cordelia Apartment to the victim CHANDRASHEKHAR KUMAR as per Sales Agreement on 31st March 2017, The Victim paid the entire sum online & via Bank Cheque (banking transactions details will be submitted). Victim has already Paid Rs. 5,850,285/- (Rs. Fifty-Eight Lakhs Fifty-Thousand and two Hundred eighty-five) Full & Final amount of Flat from 31st March 2017 to 23rd May 2020. Accused however committed fraud and has already taken a loan of Rs. 40,00,000/- (Forty Lakhs amount) on the same flat from Bank PNB Housing Loan Hyderabad branch since 2016 in the name of Shree Abhinav Kartik from as per File no. HOU/HYD/0916/316188 which is already in progress and Builder is not paying this money to Bank. Builder has done fraud by selling the same property to two people on record while 1st buyer is a bogus buyer who has facilitated to get Funds and promised bank to pay EMI for his Loan. He is not providing Registration for the property.
